These Terms of Service (the "Terms") are a binding agreement between you and Bobeari Team ("we", "us", or "our")
governing your access to and use of the Bobeari app and related services (the "Services").
By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2) Eligibility
You must be at least 17 years old to use the Services. By using the Services, you represent that you meet this requirement
and have the legal capacity to enter into these Terms.
3) Accounts
Account information
Some features may require an account. You agree to provide accurate, current, and complete information (such as name, username, and email)
and to keep it updated.
Account security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
If you believe your account has been compromised, contact us promptly.
Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, if required by law,
or to protect the Services or other users.
4) The Services
Bobeari helps you record and compare coffee brew profiles, including grinding settings, water temperatures, extraction times, and flavor notes,
and save favorite formulas for future use.
We may modify, update, or discontinue parts of the Services at any time, including adding or removing features.
5) Optional server-side / AI-assisted processing features
Some features may allow you to submit text or images for server-side processing that can include automated analysis or generation
("AI-assisted processing"). You control whether you upload content and whether you use these features.
- Our servers only: processed on infrastructure controlled by Bobeari Team.
- No third-party sharing for processing: we do not share uploaded text/images with third-party providers for this processing.
- Deletion after processing: uploaded content is deleted promptly after processing completes (unless you choose to save the output).
- No training / marketing use: we do not use uploaded content to train AI models or for advertising/marketing.
6) User content
"User Content" means content you create, upload, submit, or store through the Services (including brew records, notes, images, and support messages).
You retain ownership of your User Content as between you and us.
License to operate the Services
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display your User Content
solely as necessary to provide, maintain, and improve the Services and to comply with law.
Your responsibilities
- Do not upload content that infringes intellectual property or privacy rights.
- Do not upload unlawful, harmful, or abusive content.
- Do not upload malware or attempt to interfere with the Services.
7) Acceptable use
- Do not misuse, disrupt, or interfere with the Services.
- Do not attempt to gain unauthorized access to accounts or systems.
- Do not reverse engineer or circumvent security or access controls (except where prohibited by law).
- Do not use the Services to violate any law or regulation.
8) Privacy
Our collection and use of personal information are described in our Privacy Policy (separate from these Terms).
By using the Services, you acknowledge that we may process your information as described there.
9) Third-party services and device features
The Services may interact with third-party services or device features (such as operating system services).
We are not responsible for third-party services, and your use of them is governed by their terms and policies.
10) Apple App Store terms
If you obtain the App from the Apple App Store:
- These Terms are between you and Bobeari Team, not Apple.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation to the maximum extent permitted by law.
- Apple is not responsible for addressing claims relating to the App, including product liability, compliance with legal requirements, or consumer protection claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
BOBEARI IS A COFFEE JOURNALING AND ASSISTANCE TOOL AND DOES NOT PROVIDE PROFESSIONAL OR MEDICAL ADVICE. YOUR USE IS AT YOUR OWN RISK.
12) Limitation of liability
To the maximum extent permitted by law, Bobeari Team will not be liable for any indirect, incidental, special, consequential, or punitive damages,
or any loss of profits, revenue, data, or goodwill arising from your use of the Services.
To the maximum extent permitted by law, Bobeari Team's total liability for all claims will not exceed the amount you paid (if any) to use the
Services in the 12 months before the event giving rise to the claim.
13) Indemnification
You agree to indemnify and hold harmless Bobeari Team from and against claims, liabilities, damages, losses, and expenses (including reasonable
attorneys' fees) arising from your User Content, your use of the Services, or your violation of these Terms or applicable law.
14) Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will provide notice within the App or by other appropriate means.
Your continued use after the updated Terms become effective constitutes acceptance of the updated Terms.
15) Governing law; dispute resolution; arbitration
Governing law
These Terms are governed by the laws of Bobeari Team's principal place of business, without regard to conflict of laws rules, except where your
local law requires otherwise.
Binding arbitration
Except where prohibited by law, disputes arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an
individual basis (not class, consolidated, or representative actions).
Nothing prevents either party from seeking injunctive or equitable relief to protect intellectual property rights, confidential information,
or to prevent unauthorized access or misuse of the Services.
16) Miscellaneous
- Entire agreement: these Terms are the entire agreement regarding the Services.
- Severability: if any provision is unenforceable, the rest remains in effect.
- No waiver: failure to enforce a provision is not a waiver.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a business transfer.
